2. SUBJECT MATTER
These conditions govern the distance selling of YouEver Beauty branded cosmetic products carried out through the website youever-beauty.com. Sales are directed at adult consumers resident in Italy or in another country of the European Union. By placing an order you declare that you are at least 18 years old and have the capacity to enter into binding contracts.
The applicable conditions are those published on the website at the time you submit your order. We invite you to save or print a copy of them.
3. PRODUCTS
The products sold are cosmetics complying with Regulation (EC) No 1223/2009. The descriptions, photographs and information published serve descriptive and commercial purposes: they do not constitute medical advice, do not replace consultation with a doctor or a dermatologist and do not attribute therapeutic or disease-prevention purposes to the products. The images are as faithful as possible, but slight differences in colour or packaging due to screen rendering or a change of batch do not constitute a lack of conformity.
Before use, always read the directions and warnings shown on the label and check the list of ingredients if you know that you are sensitive or allergic to a substance.
4. PRICES
All prices are expressed in euro and include VAT. Shipping costs, where payable, are indicated separately and calculated at checkout before the order is confirmed. We reserve the right to change prices at any time: the change has no effect on orders already confirmed.
In the event of an obvious clerical error in the indication of a price, we will contact you before processing the order and you will be able to choose whether to confirm it at the correct price or cancel it free of charge.
5. CONCLUSION OF THE CONTRACT
The procedure takes place in these steps: you add the products to the cart, enter the delivery and billing details, choose the shipping and payment method, check the order summary and confirm it. Before confirming, you will be able to correct any data entered.
The submission of the order constitutes your offer to purchase. The contract is concluded at the moment we send you the order confirmation e-mail. Should a product turn out to be unavailable after confirmation, we will inform you without delay and refund the corresponding amount in full.
We reserve the right not to process orders that show signs of suspected fraud, incomplete or manifestly incorrect data, or quantities incompatible with a purchase for personal use.
6. PAYMENTS
The accepted payment methods are indicated at checkout. Payment data is processed directly by the payment service providers over encrypted channels: YouEver S.r.l. has no access to full card numbers and does not store them. The charge is made upon confirmation of the order.
An electronic invoice is issued on request, if you provide us with the necessary details when ordering.
7. SHIPPING AND DELIVERY
Times, areas served and costs are set out in the Shipping Policy, which forms an integral part of these conditions. If you are purchasing as a consumer, the risk of loss of or damage to the products passes to you only at the moment when you, or a third party designated by you other than the carrier, take physical possession of the goods (art. 63 of the Italian Consumer Code — Codice del Consumo, Legislative Decree 206/2005). Unless we indicate a different deadline, delivery takes place in any case within 30 days of the conclusion of the contract.
8. RIGHT OF WITHDRAWAL
You have the right to withdraw within 14 days of receipt of the products, without giving reasons. The procedure, conditions, return address, refund timescales and the exception provided for by art. 59(1)(e) of the Italian Consumer Code (Codice del Consumo, Legislative Decree 206/2005) for sealed products opened after delivery are described in the Returns and Refunds Policy, which also forms an integral part of these conditions.
9. LEGAL GUARANTEE OF CONFORMITY
All products are covered by the legal guarantee of conformity of 24 months from delivery, pursuant to arts. 128 et seq. of the Italian Consumer Code (Codice del Consumo, Legislative Decree 206/2005). No clause of these conditions excludes or limits the mandatory rights granted to the consumer by law.
10. USE OF THE WEBSITE
You may access and use the website exclusively for lawful purposes. In particular, it is not permitted to interfere with the operation of the website or its security measures, to extract its content systematically by automated means, to use the content for unauthorised commercial purposes, or to include in reviews and communications any content that is false, offensive, defamatory or harmful to the rights of others. We may remove content that breaches these rules and suspend access in the event of abuse.
11. INTELLECTUAL PROPERTY
The YouEver Beauty trade mark, the logo, the texts, the photographs, the graphic content and the structure of the website are the exclusive property of YouEver S.r.l. or are used under a proper licence, and are protected by Italian and European copyright and trade mark law. Reproduction, distribution, modification and any use, even partial, without written authorisation are prohibited. The right of quotation within the limits provided for by law is unaffected.
12. PERSONAL DATA
The processing of personal data is described in the Privacy Policy, to which full reference is made. The data controller is YouEver S.r.l.
13. LIABILITY AND FORCE MAJEURE
We undertake to keep the website accurate, up to date and available, but we do not guarantee the absence of errors or omissions or the continuity of the service, which may be suspended for maintenance. We are not liable for delays or failures to perform due to force majeure or to events beyond our reasonable control, such as strikes, natural disasters, network outages or measures taken by the authorities. In any event, our liability is never excluded or limited in cases of wilful misconduct, gross negligence, personal injury or breach of mandatory consumer protection rules.
14. COMPLAINTS AND DISPUTE RESOLUTION
You may send complaints to info@youever-beauty.com: we reply within 5 business days. Consumers resident in the European Union may also turn to the European online dispute resolution platform, available at ec.europa.eu/consumers/odr
15. APPLICABLE LAW AND PLACE OF JURISDICTION
These conditions and the contracts arising from them are governed by Italian law. The application to the consumer of any more favourable and mandatory provisions of the law of the European Union country in which they reside remains unaffected. For disputes with a consumer, the court of the place of residence or elected domicile of the consumer has exclusive jurisdiction, pursuant to art. 66-bis of the Italian Consumer Code (Codice del Consumo, Legislative Decree 206/2005).
16. AMENDMENTS
We may update these conditions for operational, legal or regulatory reasons. The version applicable to your purchase is the one published on the website at the time you submit your order.
17. FINAL PROVISIONS
The invalidity or ineffectiveness of any single clause does not affect the validity of the remaining ones. Failure to object immediately to a breach does not constitute a waiver of the right to invoke it later. These conditions, together with the Shipping Policy, the Returns and Refunds Policy and the Privacy Policy, constitute the entire agreement between the parties in relation to purchases made on the website.
